Estate of Will- Elijah Bailey

Upshur County} I Elijah Bailey of the said County of Upshur being
of sound and disposing mind
and memory and being desirious to settle my worldly affairs while I
have strength so to do, do make
this my last Will and Testament hereby revoking all others heretofore
by me made.
Item 1st- I desire and direct that my just debts be paid by my executor,
to be hereafter appointed.
Item 2nd- I give and bequeath to Edney Y Bailey, my wife the tract
of land on which I now live
known as the DEAN Place, containing 409 acres more or less and I bequeath
also at the death of
Edney Y. Bailey, my wife said land be and are hereby set apart for a
child which is unborn be the
heir of Edney Y. Bailey, my wife child not yet born.
Item 3rd- I bequeath that Jessee G. Bailey my son have choice of my
mules and Edney Y. Bailey,
my wife have second and third choice.
Item 4th- I bequeath that my farm known as the Old Place, be rented
out for the next three years to
come and proceeds thereof to be applied for the education of Jessee
S. Bailey, M.A.C Bailey, S.J.
Bailey and that they be schooled for three years.
Item 5th- I desire that Edney Y. Bailey, my wife have six cows and
calves and one years provision
for her and my minor children.
Item 6th- I bequeath that my 3 minor children have a cow and calf apiece
and also during the next 3
years, my executor sell all my surplus stock and collect my debts not
collected and at the end of
three years an equal division be made between all my heirs consisting
of my wife and her child,
Malinda Kidd, Martha Reeves, Lizzie P. Davis, Salina Reeves, John W.
Bailey, Sarah Smith, A.M.
Bailey, J. S. Bailey, M.A.C. Bailey, S.J. Bailey.
Item 7th- I bequeath to Edney Y. Bailey, my wife a sufficient amount
of tools to include 3 plows -
consistings of gears, hoes and so forth.
Item 8th- I hereby constitute and appoint Counce M. Reeves and Isham
H. Steed executors of this
my Last Will and Testament.
In testimony whereof I have hereunto set my hand and seal this
the 18th of September, One
Thousand Eight Hundred and Sixty Six.

Signed sealed and delivered by Elijah Bailey as his Last Will and Testament
in the presence of us the
atesting witnesses who have here unto subscribed our names in the presence
of Elijah Bailey at his
special instance and request, this 18th day of December 1866.
