Whereas at a meeting of the Members of Nacogdoches Division No. 3 Sons of Temperance held at their Hall on this
the third day of February A.D. 1860 the following preamble and Resolutions were unanimously adopted, "Whereas the Members of Nacogdoches Division No. 3 Sons of Temperance have petitioned the division in view of its present condition of suspended usefulness to transfer its Hall and lot to the Trustees of Nacogdoches University for school purposes, and the division being of the opinion that such a disposition of said property will best promote the public inetersts. Therefore Resolved that the worthy Patriarch James H. Starr and Recording Scribe James R. Arnold do make to the Trustees of said University a deed for said lot and Hall with the furniture and Bible belonging to the same. Transfer being accompanied with the understanding that said Trustees shall establish two free Scholarships in said institution either in the male or female department or both in consideration of such transfer Such Scholarships to be perpetual. The Students to be selected by the Trustees. Said Trustees having also the privilege of suspending said Scholarships for limited periods in case they should deem it best to do so, and a deed thus executed shall pass fully the title to said property." Now therefore we James H. Starr Worthy Patriarch of said Division and James R. Arnold Recording Scribe of the same in consideration of the premises, and in compliance with the foregoing resolution, have this day granted, bargained, sold aliened and delivered and by these presents do grant bargain sell alien convey and deliver unto the Trustees of Nacogdoches University, their Successors and assigns the following described lot in the Town of Nacogdoches, (bounded 3/4 North by Hospital Street. West by a line parallel with North Street and ten feet West of the great Pecan Tree which was the boundary agreed upon between Nathaniel Amory and Ephraim Coon for the East boundary of said Coons lot, now belonging to and occupied by Albert A Nelson fronting seventy two feet on said Hospital Street, and running back one hundred and thirty eight feet. The foregoing described lot being part of a lot purchased by Nathaniel Amory of Louis Claude Marie Chambodut per deed bearing date 21st March 1850 recorded Book J pages 416 & 417 Nacogdoches County Records. The said Chambodut having purchased said lot of Madame Remy Totin per deed before William Penn Morrow Notary Public for the Parish of Nachitoches, State of Louisiana dated at said Parish the twelfth of March one thousand eight hundred and fifty. The lot being described in this last named deed as follows "it being the same lot sold by Pedro Gonzales through his attorney J. A. Cherino to Remigio Totin per deed dated November 1827 in the Archives of Nacogdoches, having Sixty varas front bounded West by lot formerly known as that of Baltazar dela Garza and that of Madam Dell. East by lot formerly known as that of Juan de Gonzales South by lot of Manuel and Jose Cordova" and conveyed to Nacogdoches Division No. 3 Sons of Temperance by Nathaniel Amory per deed dated twenty fourth day of May one thousand eight hundred and fifty) and also the furniture belonging to the Hall on said lot and the Bible mentioned in the foregoing Resolution. To Have and to hold said above described lot of Ground together with all and singular the rights hereditaments and appurtenances to the same belonging or in any wise incident or appertaining to them the said Trustees of Nacogdoches University their Successors and assigns forever. In testimony whereof we have hereunto set our hands and affixed the seal of said Division on the day and year first aforesaid. | |
