Warranty Deed, I. M. POWELL and Mary J. POWELL to W. I. POWELL

The State of Texas, County of Leon.
  "Know all men by these presents that we I. M. POWELL & wife Mary J. POWELL, of the County of Leon and State of Texas for and in consideration of the sum of Three Dollars per acre $192.00 Dollars taken by W. I. POWELL as his portion of the I. M. POWELL Real Estate have Granted, Sold and Conveyed, and by these presents do Grant, Sell and Convey unto the said W. I. POWELL and his heirs of the County of Leon and State of Texas to the following described tract or parcel of land situated in Leon Co. State of Texas and being a part of the headright League of B. F. WHITAKER and being more fully described by metes and bounds as follows:  Beginning on the S. E. line of a survey made out of said League of land originally a part of the tract for Jas TAYLOR; a post oak for corner marked X about 10 in. diameter, Thence S 37 1/2 degrees E 200 vrs. to a stake from which a p[ost] o[ak] 24 in. in diameter bears N 52 1/2 degrees E 13 1/2 vrs.; another [post oak] 20 in. diameter bears N 68 E 11 vrs., both marked X; Thence S 52 1/2 W 985 vrs. to a stake on West line of said League from which a Black Jack bears N 20 E 10 vrs.; and another Black Jack bears S 5 W 6 vrs., marked X; Thence N 37 1/2 degrees W 543 vrs. to a stake for corner, Thence a straight line back to the place of beginning containing 64 (sixty four) acres of land more or less. To have and to hold the above described premises, together with all and singular the rights and appurtenances thereto in anywise belonging, unto the said W. I. POWELL his heirs and assigns, forever.  And I do hereby bind myself my heirs, executors and administrators, to Warrant and forever defend, all and singular the said premises unto the said W. I. POWELL his heirs and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof.
Witness our hands at Wealthy this 8th day of Dec. A. D. 1906."

Certification:  State of Texas, County of Leon.  "Before me, R. V. HOLLEMAN, a Notary Public in and for Leon County, Texas, on this day personally appeared I. M. POWELL known to me to be the person whose name is subscribed to the foregoing instrument and acknowledged to me that he executed the same for the purposes and consideration therein expressed.  Given under my hand and seal of office, this 8 day of Dec. A. D. 1906."

POWELL, known to me to be the person whose name is subscribed to the foregoing instrument and having been examined by me privily and apart from her husband, and having the same by me fully explained to her, she, the said Mary J. POWELL acknowledged such instrument to be her act and deed, and declared that she had willing signed the same for the purposes and consideration therein expressed, and that she did not wish to retract it.
