QUARANTINE REGULATION
THE STATE OF TEXAS}
COUNTY OF HENDERSON}


Whereas it has been made to appear to this Court that there exists
smallpox within Henderson county, Texas, at and near Athens and that
there is great danger of a spread of said disease there from.
It is therefore ordered, adjudged and decreed by this Court that
quarantine be and is hereby declared within the following described
territory, towit:
About two miles east of the town of Athens, and about 300 yards south of
the road leading from Athens to Dr. Jenkins’s farm in the Royall old
field, embracing a territory of 400 yards square in the center of which
territory is situated a detention camp and a pest tent.
And all persons whomsoever within the limits of said territory are hereby
prohibited from departing from said territory, and all persons are
prohibited from going into said territory under the pains and penalties
prescribed by the penal laws of this state.
It is further ordered by this Court that Dr. J. C. Hodge, county health
officer, declare and maintain quarantine herein proclaimed, and that he
establish, proclaim and enforce all such rules and regulations consistent
with law to make said quarantine effective.
It is further ordered and declared by this Court that the said Dr. J. C.
Hodge, health officer aforesaid, by and with the advice and consent of
Paul Jones, county judge, and C. R. Pickle, county commissioner, of said
Henderson county, have established a quarantine station and quarantine
lines, wherein shall be kept, being the territory above set out, all such
persons affected or suffering with smallpox, and the said J. C. Hodge,
the county judge and the county judge and the county commissioner are
hereby authorized to employ guards, nurses, and perform all other duties
required to make this proclamation effective.
It is further ordered by this Court, that this order be published and
that a copy thereof be served upon or left at the residence of every
family in said territory at once.
Article 478 of the criminal laws of this state is as follows, towit:
“Any person coming from any part or district infected with yellow fever
or any other infectious disease or contagious disease who shall knowingly
evade any guard or pass through any cordon of quarantine established
shall be deemed guilty of a misdemeanor and upon conviction by any court
of competent jurisdiction be punished by fine not exceeding one thousand
dollars.”
All persons are hereby warned against a violation of any rule or rules
promulgated by Dr. J. C. Hodge, county health officer, in the furtherance
of said order, and the guards acting under the direction of the said Dr.
J. C. Hodge, or any sheriff or constable of Henderson county, Texas, are
instructed and enjoined to follow up and arrest wherever found any person
or persons violating the same.
