The State of Texas,

To all Persons interested in the Administration of the Estate of  Elizabeth Miller
 deceased:
John M Randolph has filed in the District Court of Burleson
County and Application for  the Probate of the Last
Will and Testament of Elizabeth Miller
deceased
which will be heard at the next Term of said Court, commencing on the first Monday in
December     next, at the Court House in the town of Caldwell at which
time all persons interested in said Administration may appear and contest said application if they  see proper.

   Given under my hand and the Seal of said Court at office this the

The State of Texas }  Estate of Elizabeth
Burleson County    }  Miller deceased
        District Court
        December Term 1871

To the Honorable District Court of said County.    The petition of John M
Randolph shows that Elizabeth Miller died on or about the           day of May
1862.  Leaving an Estate consisting of Real and personal property, and a will
duly executed as petitioners believes that said Elizabeth Miller at the
time of her death resided in said county that said petition is the  sole Legate
named in said will, that the           of said                  owes no debts; and
that there is no necessity of any administration of her Estate.  Petitioner  prays
             of their applications be given by                    duly                   that Said
will be probated

Estate of                  }     In the matter of the last will
Elizabeth Miller      }     of said Elizabeth Miller., deceased
          deceased                         S.  S. Dec. 12th 1871
  Upon hearing the petitions of John
M.  Randolph for probate of a certain instrument of
writing now produced in court, purporting and
alleged to be the last will of Elizabeth Miller
deceased, and for letters testimony therein and on
reading the testimony of Charles Covington, a
statement of which is filed with the papers of ths
cause, it is ordered and decreed that said
instrument of writing is proved and be recorded
as the last will of said Elizabeth Miller, deceased
 and that the testimony be also recorded with said
will.          It is further ordered that letters
testimony there or be spared
that he signed as witness the paper purporting to be the Last
Will and Testament of Elizabeth Miller dated the 25th day of
April A.D. 1862  (here exhibited) in the presence of the other
subscribing witness and the testatrix now deceased and
that she signed the same by making her mark in his
presence, and acknowledged the same to be her last will
amd testament,. That the deceased was over the age of
twenty one years and of sound mind when she signed
 the same.  And that himself and the other subscribing
witness were both over the age of fourteen years at
the time of the execution of the same, and that they
signed the same as witnesses at the request of the
 testatrix.

The State of Texas            This day personally appeared before me, Thomas
County of Burleson   }      Johnston Chief Justice in and for said
County, L. Shoemake, one of the sub2scribing witensses to the
foregoing Instrument of Writing on the reverse herself, who being
duly sworn deposeth and saith that he saw Elizabeth Miller
whose name appears to said instrument by her mark, signand
 deliver the same and that she acknowledged it to be her act and deed for
all the consideration and purposes therein  written and expressed, in
his presence and the other subscribing witness and that he so signed the
same as a witness by the request of said Elizabeth  Miller.  To
 Witness my hand this 6th June 1862.
